Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ManualFig ("Company," "we," "us," or "our") concerning your access to and use of the manualfig.ai website and our AI-powered product instruction illustration services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into this agreement
• You will comply with all applicable laws and regulations
• All information you provide is accurate, current, and complete

Account Registration and Security

Account Creation

To access certain features of the Service, you must register for an account by providing:

• Valid email address
• Secure password
• Required profile information

You may also register using third-party authentication services (Google, GitHub).

Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains accurate and up-to-date

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account remains inactive for an extended period
• We discontinue the Service

You may delete your account at any time through your account settings or by contacting us.

Service Description

ManualFig provides an AI-powered platform for creating product instruction illustrations, including:

• Prompt-Based Illustration Generation: Create instruction figures from text descriptions of products and procedures
• Reference-Guided Generation: Transform uploaded product photos, CAD screenshots, sketches, or manuscripts into manufacturer-style illustrations
• Procedural Panel Layouts: Generate consistent multi-panel sequences for IFU sheets, user manuals, quick start guides, installation guides, safety instructions, and maintenance workflows
• Style Replication: Generate illustrations that match a specified visual style or reference image
• Templates: Pre-designed templates for common product documentation scenarios
• Multi-Round Editing: Iteratively refine generated illustrations through targeted text instructions
• Asset Storage: Secure cloud storage for your uploads, generated illustrations, and exports

Subscription Plans and Pricing

Available Plans

We offer multiple subscription tiers:

• Free Plan: Limited features with restricted credits
• Starter Plan: Monthly or annual subscription with included credits for individual users
• Pro Plan: Monthly or annual subscription with higher credit allowances and advanced features (recommended)
• Business Plan: Monthly or annual subscription for teams with the highest credit allowances
• Lifetime Plan: One-time purchase for permanent access (subject to fair-use limits)

Current pricing is displayed on our pricing page and may be updated with reasonable notice.

Billing and Payment

• Payment Processing: All payments are processed securely through Stripe
• Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless canceled
• Billing Cycle: Charges occur on the same day of each billing period (monthly or annually)
• Price Changes: We will notify you at least 30 days before any price increases
• Payment Failure: If payment fails, we may suspend your account until payment is received
• Taxes: You are responsible for any applicable taxes, duties, or government fees

Credit System

• Credit Allocation: Credits are allocated based on your subscription plan
• Credit Usage: Credits are consumed when using AI generation features
• Credit Expiration: Credits expire according to your plan terms (typically 30 days)
• Credit Packages: Additional credits can be purchased separately
• No Refunds: Unused credits are non-refundable

Cancellation and Refunds

Subscription Cancellation:

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• You will retain access to paid features until the end of the billing period
• No partial refunds for unused time in a billing period

Refund Policy:

• We offer refunds within 14 days of initial purchase if you have used less than 10% of your allocated credits
• Refunds for technical issues will be evaluated on a case-by-case basis
• Credit package purchases are non-refundable
• Lifetime plan refunds are subject to the same 14-day, less-than-10%-credit-usage window
• Processing Fee: A 10% processing fee will be deducted from all approved refunds to cover non-refundable payment processing costs (including Stripe transaction fees, currency conversion fees, and administrative overhead). For example, a $100 refund will return $90 to your original payment method.

Chargebacks:

• Initiating a chargeback without contacting us first may result in account suspension
• Fraudulent chargebacks may result in permanent account termination

Acceptable Use Policy

Permitted Uses

You may use the Service to:

• Create product instruction illustrations for IFU sheets, user manuals, quick start guides, installation guides, safety instructions, and maintenance workflows
• Generate visuals for product documentation, training materials, and customer support content
• Develop visual content for compliance, regulatory, and consumer-facing documentation
• Store and manage your generated illustrations and project assets

Prohibited Uses

You may NOT use the Service to:

• Generate illegal, harmful, or offensive content
• Violate any applicable laws, regulations, or third-party rights
• Infringe on intellectual property rights of others, including by uploading copyrighted product imagery you do not have rights to use
• Create content for fraudulent or deceptive purposes (e.g., counterfeit product documentation, falsified safety instructions, or misleading regulatory submissions)
• Generate content that promotes violence, hatred, or discrimination
• Attempt to reverse-engineer, hack, or disrupt the Service
• Share your account credentials with others
• Resell or redistribute generated illustrations without proper licensing where required
• Scrape or automatically collect data from the Service
• Overwhelm the Service with excessive requests (API abuse)
• Use the Service to fabricate compliance, certification, or safety documentation that has not been validated by the responsible manufacturer

AI Content Guidelines

• You are responsible for the prompts, products, and reference assets you submit to the AI
• Generated illustrations are decorative and explanatory aids, not substitutes for engineering drawings, regulatory submissions, or certified safety documentation; you must independently verify accuracy before relying on any generated content for compliance, safety, or production purposes
• Generated content must comply with ethical and legal standards
• We reserve the right to review and remove content that violates these Terms

Intellectual Property Rights

Our Intellectual Property

The Service, including its design, features, code, and content, is owned by ManualFig and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of the Service
• Use our trademarks or branding without permission
• Reverse-engineer or decompile any part of the Service

Your Content

User Inputs: You retain all rights to content you input into the Service (prompts, uploaded product photos, CAD screenshots, sketches, descriptions). You represent that you have the necessary rights to upload and process such content.

Generated Illustrations:

• You own the illustrations created through the Service
• You grant us a limited license to store, display, and process your illustrations as necessary to provide the Service
• You may use generated illustrations for any lawful purpose, including commercial use in product documentation, training, and customer-facing materials
• You are responsible for ensuring your use of generated illustrations complies with applicable laws, including any product safety, regulatory, and labeling requirements
• Free users grant us permission to anonymously showcase their generated works in our community gallery. Paid users enjoy complete privacy protection for all their creations.

License Grant: By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store and process your inputs and generated illustrations
• Use anonymized data for service improvement and AI training
• Display your content as necessary to provide the Service

AI Training and Data Usage

• We may use anonymized, aggregated usage data to improve our AI models
• We will not use your personal information or identifiable content without consent
• You can opt-out of data usage for AI training by contacting us

Third-Party Services

The Service integrates with third-party services:

• Stripe: Payment processing (see Stripe's Terms and Privacy Policy)
• AI Generation Providers: Third-party model providers used for illustration generation
• Cloud Storage Providers: Asset storage and delivery
• Authentication Providers: Google and GitHub OAuth for social sign-in

Your use of third-party services is subject to their respective terms and policies. We are not responsible for third-party services.

Service Availability and Modifications

Service Availability

• The Service is provided "as is" and "as available"
• We do not guarantee uninterrupted, timely, secure, or error-free service
• We may experience downtime for maintenance, updates, or technical issues
• We are not liable for any loss or damage resulting from service unavailability

Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Service
• Change pricing with 30 days' notice
• Update these Terms at any time
• Impose limits on features (e.g., generation limits, storage quotas)

We will make reasonable efforts to notify you of material changes.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability: Fitness for a particular purpose
• Accuracy: Accuracy or reliability of AI-generated illustrations
• Non-Infringement: Generated content does not infringe third-party rights
• Security: Complete security or privacy of your data
• Availability: Uninterrupted or error-free operation

You acknowledge that:

• AI-generated illustrations may have imperfections, geometric inaccuracies, or stylistic deviations
• The Service is a tool and you are responsible for final content verification, including any technical, regulatory, or safety review required for your use case
• We do not guarantee specific results or quality of generated illustrations, nor that any illustration will satisfy any particular regulatory or compliance standard

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANUALFIG SHALL NOT BE LIABLE FOR:

Direct Damages

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Cost of substitute services

Indirect Damages

• Indirect, incidental, special, consequential, or punitive damages
• Damages arising from service interruptions or errors
• Damages resulting from unauthorized access to your account
• Damages arising from reliance on AI-generated illustrations for compliance, safety, or production decisions

Aggregate Liability

Our total liability to you for all claims arising from your use of the Service shall not exceed the greater of:

• $100 USD, or
• The amount you paid us in the 12 months preceding the claim

Exceptions

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless ManualFig, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you submit, generate, or share through the Service
• Your breach of any applicable laws or regulations

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.

Informal Resolution

Before filing a claim, you agree to contact us at contact@manualfig.ai to seek informal resolution. We will attempt to resolve disputes in good faith.

Arbitration Agreement

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except that:

• You may assert claims in small claims court if they qualify
• Either party may seek injunctive relief in court for intellectual property infringement

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.

Exceptions

Some jurisdictions do not allow arbitration agreements. If you are in such a jurisdiction, this arbitration provision does not apply to you.

General Provisions

Entire Agreement

These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ManualFig.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

Survival

Provisions that by their nature should survive termination (including intellectual property, liability, and dispute resolution) will survive.

Updates to Terms

We may update these Terms from time to time. Material changes will be notified by:

• Email notification to your registered email address
• Prominent notice on the Service
• Update to the "Last Updated" date

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
